Investigation & Mediation

One of MDAs core activities is carrying out investigation and mediation. We undertake independent investigations on grievances, complaints, problems and conflicts. This can be especially relevant where equality, discrimination and harassment and bullying are causing problems for an organisation.

Many organisations use our services to resolve seemingly insoluble problems. We take an objective view of the situation, interviewing all parties concerned. We can offer not only practical solutions to the immediate problem, but also recommend actions for the long term health of the organisation to prevent a recurrence and to learn.

We undertake neutral assessment where groups of staff are affected by conflict as a base for positive outcomes for all parties. Mediation is also a key part of our work, forming an essential element of resolving conflict within and across the organisation.

Discrimination law may often be a backdrop in many organisations. Some of our associates are lawyers, specialising in employment and equality law. This knowledge and training combined with experience of best practice/policy, is invaluable.

We investigate the facts and make findings, applying the same standards of proof required by an Employment Tribunal. On the basis of these findings we can diagnose where things may have gone wrong and suggest ways forward.

We measure the performance of the organisation against the best practice standards which are used by tribunals to assess liability and risk, and work with our clients to agree a strategy which will provide the best possible outcome for all parties. We have successfully represented clients from both the voluntary and private sectors at both Employment Tribunals and Employment Appeal Tribunals.

We can also provide post investigation coaching and counselling to help restore good relations in the workplace.

Our approach, wherever possible is to recommend solutions which will help the organisation to improve its management and diversity in order to reap the undisputed benefits that diversity can bring to an organisation.
